Cannabis opponents have made valiant efforts to frighten away the American public into believing that when cannabis laws are reformed there will be an immediate stoned drivers’ epidemic following for causing chaos on public streets. Cannabis has been legalized in Colorado and Washington for quite some time now and the doomsday forecasts of cannabis opponents have not yet happened. It is expected to stay the same. If not now, it is not likely to happen in future too.

Deciding if someone is stoned to such an extent that he/she cannot drive is not easy. There isn’t any reliable method to find out the cannabis intoxication level of someone; it’s not like alcohol, which can be decided precisely just by a simple breathalyzer test. As of now, there is no cannabis breathalyzer test. Even if such a test was there, it would only show that cannabis is present in the breath of a person and not if he is very much stoned to drive.

Immediate consumption of alcohol can be determined by blood tests, but for cannabis, a test only indicates whether a person has presence of cannabis in the body… It’s not possible to decide for how long it’s been there since cannabis remains in the system of a person for very long.

A defense lawyer who specializes in DUI cases and a professor explained that several tests need to be conducted in order to decide if an individual is too stoned to drive. Few of these tests are for cannabis, while few are for other drugs, and they are done to rule out other things and get to a cannabis associated infraction by elimination process. It’s quite far from concrete determination.

Cannabis effects on drivers have been studied by the federal government over the previous one year. This research was concluded during last spring, but the results haven’t yet been released. Since the study was done by the federal government, which is known for its reefer madness history, it’s not easy to take the outcomes at face value post release.
